The Cameras Are Back

As of October 1, 2008 the Cameras are back on ... and already 181 citations have gone out!

 

After a long hiatus after the Clive red light cameras were turned off after a court case deeming them unconstitutional, they have been fired back up as of October 1, 2008. 

Already  181 Citations have gone out, and more are sure to be in the pipeline.

The Iowa Supreme Court ruled in August that the cameras were legal. Clive City Manager Dennis Henderson says more people ran red lights when the cameras were shut off.

Drivers in Clive can also no longer claim that someone else was behind the wheel.

The Iowa Supreme Court, in a split ruling last month, upheld the city of Davenport’s use of traffic cameras to catch speeders and drivers who run red lights after a man challenged the city’s ordinance.

Henderson says Clive isn’t looking to add more cameras.

ACLU Looses Davenport Camera Lawsuit

A judge has ruled against an eastern Iowa man who challenged a speeding ticket issued after he was caught speeding on camera in Davenport.The Iowa chapter of the American Civil Liberties Union filed a motion to dismiss the ticket issued last March to Thomas Seymour of Bettendorf. The group claims that Seymour was denied his right to due process and that the state constitution does not give the city of Davenport the authority to issue such fines.Scott County Judge Kyle Williamson ruled that the matter is not a constitutional issue and ordered Seymour to pay the $125 fine.

An ACLU representative said the group will review the judge's decision. City Attorney Chris Jackson said the city anticipated challenges when it created the ordinance in 2004. He said the ruling this week only applies to Seymour.
